These Terms of Service (“Terms”) govern your access to and use of the website at firefueledu.com and the training games and simulations offered through it (the “Service”), provided by Fire Fueled Education LLC (“FireFuelED,” “we,” “us,” or “our”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Important — training use only. FireFuelED games are educational training tools. They are simplified for instruction and are not medical advice and not a substitute for official protocols, online or base-hospital medical direction, certification (such as NREMT, AHA, NRP, PALS, or ERC), or your own clinical judgment. Never use the Service to guide decisions during real patient care. Always follow your agency’s current protocols and medical direction.
Eligibility
You must be at least 13 years old to use the Service, and old enough to form a binding contract to make a purchase. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for that organization.
License to use the Service
Subject to these Terms and any applicable purchase or license, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own training and education.
- Demos — demo versions are provided free for evaluation and may limit play time or features.
- Individual purchases — a purchased game is licensed to you for personal use.
- Program & department licenses — organizational use (such as EMT/paramedic programs, fire departments, and EMS agencies) requires a separate license. Terms, seat counts, and any customization are set out in your licensing agreement.
Purchases, pricing, and refunds
Prices are shown on our pricing page and may change over time; changes do not affect purchases already made. Individual purchases are one-time and grant access as described at the time of purchase. Program and department licensing is billed as set out in the applicable agreement.
Because the Service consists of digital products delivered immediately, all sales are generally final. If you experience a problem with your purchase, contact us at [email protected] and we will work with you in good faith to make it right.
Acceptable use
You agree not to:
- Copy, resell, sublicense, or redistribute the Service or its content without our written permission;
- Reverse engineer, decompile, or attempt to extract source code or assets, except where permitted by law;
- Circumvent demo limits, license restrictions, or security measures;
- Use the Service in any unlawful way or to infringe the rights of others;
- Interfere with or disrupt the integrity or performance of the Service.
Intellectual property
The Service, including its software, scenarios, text, graphics, logos, and design, is owned by FireFuelED and protected by intellectual-property laws. Except for the limited license granted above, no rights are transferred to you. “FireFuelED,” “Triage It!,” “Deliver It!,” and “San Julian Trail” are marks of Fire Fueled Education LLC.
Disclaimer of warranties
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that its content is complete or current. The Service does not replace professional training, certification, or medical direction.
Limitation of liability
To the fullest extent permitted by law, FireFuelED and its members will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of (or inability to use) the Service — including any clinical decision or patient-care outcome. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the claim.
Termination
We may suspend or terminate your access to the Service if you violate these Terms. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.
Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in California, unless otherwise required by applicable law.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
